We are a company registered in Dubai, the United Arab Emirates (“UAE”). This Website, including all information, tools and services available from this Website to you, is offered by us to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting the Website and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms and Conditions”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the Website, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

SECTION 6: DISCLAIMERS
6.1 By becoming a member or customer of DMC, you voluntarily agree, of your own free will and without any coercion, to participate in contests and promotional giveaways, having fully read, understood, and accepted the following conditions:
6.1.1 Any disputes, claims, or causes of action arising out of or connected with the contest or promotional gifts will be resolved individually on a case-to-case basis and on the merits of fairness. Participants agree to pursue any such disputes on an individual basis only.
6.1.2 Any claims, judgments, or awards will be limited to the actual out-of-pocket costs incurred in entering the contest. DMC will not be liable for any legal fees or other expenses beyond these costs.
6.1.3 You waive all rights to claim punitive, incidental, or consequential damages, as well as any rights to have damages multiplied or otherwise increased.
6.1.4 DMC, its licensees, parents, affiliates, subsidiaries, related companies, advertising or promotional agencies, and their respective officers, directors, employees, representatives, and agents are not liable for any damages or losses of any kind. This includes direct, indirect, incidental, consequential, or punitive damages arising from access to, or use of, the Website, electronic or computer malfunctions, or participation in the contest, even if DMC has been advised of the possibility of such damages.
6.1.5 DMC reserves the right to disqualify any participant found tampering with or abusing any aspect of the contest, as determined solely by DMC. This includes, but is not limited to, any fraudulent activity or violation of contest rules.
6.1.6 If the contest is compromised by unauthorized human intervention, tampering, or other causes beyond the reasonable control of DMC, which corrupt or impair the administration, security, fairness, or proper operation of the contest, DMC reserves the right to suspend, modify, or terminate the contest. DMC will take necessary steps to ensure that the contest is conducted fairly.
6.1.7 Any attempt by you or any participant to deliberately damage the Website or undermine the legitimate operation of the contest is a violation of criminal and civil laws. DMC reserves the right to seek damages from any such participant to the fullest extent permitted by law and may pursue legal action if necessary.
6.1.8 DMC assumes no responsibility for any problems or technical malfunctions of computer systems, servers, software, internet service providers, or email systems. This includes any entries not received due to technical problems or incomplete, late, lost, damaged, illegible, or misdirected electronic communications.
6.1.9 The contest is void where prohibited or restricted by law. DMC reserves the right to suspend, modify, or terminate the contest to ensure compliance with legal requirements and to maintain the fairness and integrity of the contest.
6.1.10 DMC reserves the right to cancel promotional giveaways or extend the draw date of giveaways without prior notice to you. Any changes or cancellations will be at DMC’s sole discretion and will be implemented as needed to maintain the integrity of the giveaway.

7.6 DMC may, at its sole discretion, remove any content that is deemed to violate intellectual property laws or third-party rights, or that is otherwise deemed inappropriate or illegal. DMC is not responsible for any damages or losses resulting from such removal.

8.1 The Website and Service are operated by DMC from within Dubai, United Arab Emirates. All content, features, and services provided through the Website are intended to comply with the laws and regulations of Dubai.
8.2 If you choose to access the Website and/or use the Service from locations outside of Dubai, you do so at your own initiative and are solely responsible for ensuring that your use complies with all applicable local laws and regulations in your jurisdiction.
8.3 By accessing the Website from a location outside of Dubai, you agree to adhere to the laws of your country or region regarding online conduct, acceptable content, and the use of internet services. You are responsible for any legal consequences or liabilities arising from your use of the Website in a manner that violates local laws.
8.4 You agree to comply with all applicable laws and regulations concerning the transmission of technical data exported from the United Arab Emirates or the country in which you reside. This includes compliance with export control laws and regulations.
SECTION 9: REFUNDS, RETURNS, AND EXCHANGES
9.1. By purchasing a membership or a one-time package for our rewards platform, you acknowledge and agree that all sales are final. Memberships and one-time packages purchased during promotional periods or as part of giveaways are strictly non-refundable. This includes any discounts or special offers applied at the time of purchase.
9.2. Your purchase of a membership or package is a contribution to the DMC brand and its ongoing efforts to provide exclusive rewards and benefits. As such, refunds, returns, or exchanges are not available for these products, regardless of whether they are used or redeemed.
9.3 DMC reserves the right, in its sole discretion, to consider exceptions to this policy in cases where there may have been a clear error in the transaction or if required by applicable law. However, such exceptions are rare and will be evaluated on a case-by-case basis.
9.4 If you choose to cancel your membership, you may do so at any time; however, no refunds, credits, or exchanges will be provided for any remaining period of the membership term. Access to the benefits and Service will continue until the end of the current subscription period.
9.5 DMC reserves the right to modify or update this Refunds, Returns, and Exchanges policy at any time, with or without notice. Any changes will be effective immediately upon posting to the Website. Your continued use of the Website and Service after such changes constitutes your acceptance of the new terms.

11.3 The monthly Loyalty Membership provides ongoing access to a range of benefits and exclusive discounts available through the DMC platform. Membership fees are billed on a recurring monthly basis, and members can enjoy continuous access as long as their membership remains active and in good standing.

11.5 DMC reserves the right to modify, add, or remove membership options at any time, with or without notice. Any changes will be reflected on the memberships page and will apply to new memberships and renewals.
11.6 You agree to abide by DMC’s general practices, code of conduct, and guiding principles at all times, and you shall not engage in any actions or conduct that may be detrimental to DMC, its operations, reputation, or interests.
11.7 You further acknowledge and agree that DMC reserves the right to revoke or suspend your membership at any time, without refund, if you fail to abide by these Terms and Conditions, engage in misconduct, violate any applicable laws, or fail to comply with DMC’s code of conduct or usage policies. You agree that any such revocation, suspension, or termination shall be made at DMC’s sole discretion and that DMC shall have no liability, responsibility, or obligation of any kind to you or any third party arising from or related to such actions. This includes, without limitation, any claims for damages, losses, or compensation of any nature, whether direct, indirect, consequential, or incidental, resulting from the suspension or termination of your membership or access to any part of the Service.
SECTION 12: ACCOUNT REGISTRATION
12.1 ELIGIBILITY
12.1.1 To access certain features of the Website and Service, you must register and create a user profile or account (Account). Eligibility for registration is restricted to individuals aged 18 or older. By creating an Account, you represent and warrant that you meet this age requirement.
12.2 REGISTRATION INFORMATION
12.2.1 During the registration process, you may be required to provide your name, address, email address, and other relevant information, and to choose a password. You agree that all information provided to DMC for account creation (Registration Information) will be true, accurate, current, and complete. Providing false, inaccurate, or incomplete information constitutes a breach of these terms and may result in the immediate termination of your Account.
12.2.1.1 You must promptly update your Registration Information to keep it true, accurate, current, and complete.
12.2.1.2 You are responsible for maintaining the confidentiality of your password.
12.3 PROHIBITED ACTIONS
12.3.1 When creating an Account, you agree not to:
12.3.1.1 Use another person’s email address or username with the intent to impersonate them.
12.3.1.2 Use a name or email address subject to the rights of any other person without authorization.
12.3.1.3 Use an email address or username that is offensive, inappropriate, or violates any laws.
12.3.1.4 Allow any other party to use your Account and/or password.
12.4 ACCOUNT SECURITY
You are prohibited from sharing or transferring your Account or disclosing your password to anyone. You agree to immediately notify DMC at support@dubaimotorclub.com of any known or suspected unauthorized use(s) of your Account or any known or suspected breach of security, including the loss, theft, or unauthorized disclosure of your password.
12.4.1 You are liable for all activities conducted under your Account, even if such activities were not committed by you.
12.4.2 DMC is not responsible for any loss or damage arising from your failure to maintain the confidentiality of your password.
12.5 RESTRICTIONS ON PARTICIPATION IN GIVEAWAYS
Employees, directors, managers, and their immediate family members (i.e., parents, spouses, domestic partners, siblings, and children), or anyone residing in the same household as a DMC employee, director, or manager, are not eligible to win giveaways offered by DMC.
SECTION 13: TERMINATION OF ACCOUNT
13.1 You acknowledge and agree that you do not have any ownership rights in your Account. Your access to the Website and Service is provided at the discretion of DMC, and your Account may be terminated as outlined below.
13.2 DMC reserves the right to discontinue the Service or any part of it at any time, for any reason, with or without notice. This may include the termination of your Account and access to all related features and services.
13.3 DMC may, at its sole discretion, terminate your Account, remove all your Registration Information, and delete any other information or content you have provided through the Website (collectively, User Content) associated with your Account. This action may be taken at any time, with or without notice, and for any reason, including but not limited to:
13.3.1 Violation of these terms and conditions.
13.3.2 Unauthorized use of the Website or Service.
13.3.3 Any other conduct that DMC, in its sole discretion, deems harmful or inappropriate.
13.4 If you wish to cancel your Account, please contact us at support@dubaimotorclub.com and request cancellation. Upon receiving your request, DMC will send you a specific cancellation link within 24 hours. You will need to click on this link and follow the prompts to complete the cancellation process.
13.4.1 Please note that there are no refunds on memberships. If a payment has recently been made, you should cancel your membership at the end of the current billing period to avoid further charges.
13.5 DMC will not be liable for any loss, damages, or inconvenience resulting from the termination of your Account, the removal of your Registration Information, or the deletion of any User Content from the Website and/or Service. You agree that any termination of your access to the Website or Service may be affected without prior notice and acknowledge that DMC may immediately deactivate or delete your Account and all related information.
13.6 Upon termination of your Account, your right to access the Website and use the Service will immediately cease. DMC is under no obligation to retain any User Content or to forward any unread or unsent messages to you or any third party.
13.7 By using the Website and Service, you agree to these terms and acknowledge that DMC has the right to terminate your Account at its discretion, without liability for any resulting losses. You also agree to follow the outlined process should you choose to cancel your Account.

You agree to indemnify and hold DMC, its subsidiaries, affiliates, officers, agents, and other partners and employees harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of or relating to your use of the Website. 17.2 Your use of the Website to upload content or other information.
17.3 Your breach of these Terms and Conditions.
This indemnification obligation will survive the termination of your Account and your use of the Website and Service.

By becoming a member of DMC, you represent and warrant that you will not contact any affiliate, employee, sponsor, or partner of DMC with the intention of manipulating contest results. Any such attempt to influence contest outcomes will be considered a breach of these terms and conditions, and DMC reserves the right to take appropriate legal action, including the immediate termination of your membership and forfeiture of any benefits and/or entries accumulated through your membership with the DMC.
SECTION 23: TERMINATION OF LOYALTY MEMBERSHIP
23.1 To cancel your loyalty membership, please take note of the below:
23.1.1 “Email Request” Send an email to support@dubaimotorclub.com requesting the cancellation of your loyalty membership.
23.1.2 “Cancellation Link” You will receive a specific cancellation link within 24 hours. Access this link and follow the prompts to complete the cancellation process.
23.1.3 “Confirmation” Upon completion of the cancellation process, you will receive an email notification confirming the cancellation of your subscription.
23.2 “Payment Termination” Cancelling your subscription will stop all future payments associated with that subscription plan. You will also forfeit any accumulated bonus entries for future promotional giveaways.
23.3 “No Refunds” There are no refunds for memberships. If a payment has recently been made, we recommend cancelling your membership at the end of the current billing period to avoid losing that payment.
23.4 “Mailing Lists” Terminating your membership will not automatically remove you from DMC’s mailing or text lists. To unsubscribe from these communications, please use the unsubscribe links provided in the emails or messages, as they are managed by third parties.
23.5 “Failed Payment Attempts” If your account fails to process a payment, DMC will make four automatic attempts to bill it, spaced five days apart (for a total of a 20-day grace period). On the fourth and final attempt, if the payment is unsuccessful, your subscription will be terminated, and your loyalty streak will be lost.
23.6 “Subscription Reactivation” If you cancel your subscription, it cannot be reactivated through Stripe. All accumulated history for that subscription will be lost. To continue your subscription, follow the instructions provided in the notification emails or log in to the member’s dashboard and update your banking details.
23.7 “Syncing Entry History” If your account is canceled, you can sync the last active entry history by creating a new subscription within 30 days of the cancellation. Only the most recent active subscription will be synced. If multiple cancellations occur, previous entry histories will not be included if the cancellation date exceeds 30 days from the current active subscription.
23.8 “Attempt Limitations” The system allows only four attempts, including any manual attempts made by the user, to charge the account.
SECTION 24: SEVERABILITY
In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 25: ENTIRE AGREEMENT
Our failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. SECTION 22: REPRESENTATIONS AND WARRANTIES OF MEMBERS
By becoming a member of DMC, you represent and warrant that you will not contact any affiliate, employee, sponsor, or partner of DMC with the intention of obtaining any unfair advantage in relation to DMC’s services or activities. Any such attempt will be considered a breach of these terms and conditions, and DMC reserves the right to take appropriate legal action, including the immediate termination of your membership.
SECTION 23: TERMINATION OF MEMBERSHIP
23.1 To cancel your membership, please take note of the below:
23.1.1 “Email Request” Send an email to support@dubaimotorclub.com requesting the cancellation of your membership.
23.1.2 “Cancellation Link” You will receive a specific cancellation link within 24 hours. Access this link and follow the prompts to complete the cancellation process.
23.1.3 “Confirmation” Upon completion of the cancellation process, you will receive an email notification confirming the cancellation of your subscription.
23.2 “Payment Termination” Cancelling your subscription will stop all future payments associated with that subscription plan.
23.3 “No Refunds” There are no refunds for memberships. If a payment has recently been made, we recommend cancelling your membership at the end of the current billing period to avoid losing that payment.
23.4 “Mailing Lists” Terminating your membership will not automatically remove you from DMC’s mailing or text lists. To unsubscribe from these communications, please use the unsubscribe links provided in the emails or messages, as they are managed by third parties.
23.5 “Failed Payment Attempts” If your account fails to process a payment, DMC will make four automatic attempts to bill it, spaced five days apart (for a total of a 20-day grace period). On the fourth and final attempt, if the payment is unsuccessful, your subscription will be terminated.
23.6 “Subscription Reactivation” If you cancel your subscription, it cannot be reactivated through Stripe. All accumulated history for that subscription will be lost. To continue your subscription, follow the instructions provided in the notification emails or log in to the member’s dashboard and update your banking details.
23.7 “Syncing Membership History” If your account is canceled, you can sync the last active membership history by creating a new subscription within 30 days of the cancellation. Only the most recent active subscription will be synced. If multiple cancellations occur, previous histories will not be included if the cancellation date exceeds 30 days from the current active subscription.
23.8 “Attempt Limitations” The system allows only four attempts, including any manual attempts made by the user, to charge the account.
SECTION 24: SEVERABILITY
In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 25: ENTIRE AGREEMENT
Our failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. These Terms and Conditions and any policies or operating rules posted by us on this Website or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions). 26.1. These Terms and Conditions and any separate agreements whereby we are engaged to provide you services shall be governed by and construed in accordance with the laws of UAE. Any dispute arising out of the formation, performance, interpretation, nullification, termination or invalidation of these Terms and Conditions or arising therefrom or related thereto in any manner whatsoever, shall be settled by arbitration in accordance with the provisions set forth under the Dubai International Arbitration Centre (DIAC) Rules by a single arbitrator appointed in compliance with the Rules.
26.2. The seat of arbitration shall be Dubai, and the language shall be English. The DIAC shall have the exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions. Each party irrevocably waives any objection, including any objection to the laying of venue or based on the grounds of forum non-convenience, which it may now or hereafter have to the bringing of any action or proceeding in such jurisdiction in respect of these Terms and Conditions.
